My tenant is not paying the rent. What can I do?
Situations in which tenants refuse to pay rent are depressingly familiar for landlords. While many tenants fear falling short on their rent, getting people to pay late rent payments is more complicated than it looks for many landlords. Landlords frequently resort to two basic strategies, neither of which will be very effective.
1) Ignore the problem of rent collection
They will ignore the problem. Some tenants will run into landlords who barely seem to react when they stop paying the rent. Landlords in this situation are more or less hoping that the problem will resolve itself in some way. They might expect their errant tenants to eventually move out independently. They might also be living, hoping that the current situation is just a temporary problem and that the tenants in question will give them the rent money when they’re ready.
From my experience, this passive approach is rarely going to be effective. For one thing, tenants who refuse to pay are often baiting their landlords, trying to wait and see how long their landlords are willing to give them. Overly patient landlords will provide tenants with the impression that they can get away with very late payments, and tenants prone to late fees at the best of times will extend this imaginary deadline further. Landlords should know that these situations can go on for years. I have seen this happen many times. They won’t move out of a problem that seems to be favoring them. If they feel that they’ve found themselves in the company of an unusually tolerant landlord, they will know full well that they’re unlikely to find an arrangement like that elsewhere, and they will be that much less likely to rock the boat by moving.
2) Respond with overt aggression in rent collection
Landlords will respond to the problem with overt aggression, a relatively standard strategy. Many landlords are fed up with tenants who always have excuses and will try to establish dominance with their tenants. Sadly, the power differential between tenants and their landlords has always been more complicated than that. The landlords might have the keys and be the rightful owners of the property in question. Still, the tenants know that the eviction process can be complicated and time-consuming and that many landlords would prefer to avoid it altogether.
There’s also the fact that anytime anyone lets a person into their property, that person will have a certain degree of power over them. Some angry or bitter tenants take out their frustrations on their landlords by causing property damage. While it is possible to take legal action in these cases, making this action pay off will be trickier. Tenants who are constantly late on payments, especially if they seem to stop paying altogether, are already hurting the profit margins of their landlords. If they cause expensive property damage simultaneously, the situation will be complicated for landlords to deal with in the long run.
Landlords who approach the situation overly aggressively right from the start are also going to burn themselves out that much more rapidly. Starting by approaching the problem passively will be frustrating, but at least landlords in that situation can escalate the conflict. Landlords who began by being aggressive aren’t going to have any room to go when it’s time to exercise more dominance. Uncooperative tenants are going to realize this at some level. They’re already essentially challenging their landlords by refusing to pay their bills and refusing to move, living there effectively rent-free all the while. Landlords have to be able to respond to the challenge effectively, which isn’t going to happen if they expend all of their resources early in the game.
Every month with a tenant who isn’t paying the rent is another month in which a landlord could have received rent money from a much more reliable tenant. Opportunity cost is a problem in every business. Still, it can get particularly frustrating in the real estate business, where bad tenants can cost landlords thousands of dollars, and replacing them with good tenants can be tricky.
It is time to take action with a 3 Day Eviction Notice.
Tenants who aren’t paying their bills should receive a warning. Landlords should send them emails describing the situation in detail. The email can contain all the legal steps the landlord will take to handle this problem properly. The tenants should then receive a 3-Day Eviction Notice.
The tenants who were effectively testing the landlord in question will know that the situation has changed at that point. Their landlords mean business and will either have to meet their demands or leave, which is very much the response landlords should want. Some formerly passive tenants will respond to this situation by paying their overdue rent bills, while others will move out as directed. One way or another, this group should solve the problem by morning.
Tenants who are being more difficult or passive-aggressive will need more convincing than that. Challenging their landlords is half of the reason they’re doing this in the first place. They will also be well aware that an eviction notice still needs to be enforced, and many are more than willing to go through this sort of legal battle with their landlords. Landlords will need to file the eviction with these people, and they will have to endure the subsequent legal struggle.
We are here to help property owners with rent collection.
Fortunately, landlords in the Tampa Bay Area of Florida aren’t alone. Langee Realty Inc. is a residential property management company that can help landlords in situations like these, along with all other landlords who have had to deal with challenging tenants who never seem to want to shape up without being forced into it. This professional assistance will make all the difference for landlords who are used to dealing with difficult tenants when they’re alone.
Even some of the most challenging tenants know they can not intimidate Langgee Realty Inc.’s professional property management. They realize that their owner means business and that there’s a force behind their owner’s threats. Working with a property management company helps establish that impression quite well. We have experience dealing with bad tenants. Many times, when the tenant finds out that the owner has hired our Profesional Property Company. They either state that they are paying rent on time or have moved out of the rental property. The farther a tenant gets behind, the less likely they are to pay rent. 📜
